5MC's data controller is established in the European Union and processes personal data primarily under the General Data Protection Regulation ("GDPR"). The GDPR does not use the concept of a "sale" of personal information found in US privacy laws; instead, it gives you a direct, enforceable right to object to certain processing and to control how your consent is used. This page explains those rights and, separately, addresses the position for California and other US-based visitors, for whom the concept of "sale" or "sharing" of personal information is legally relevant.

1. 5MC Does Not Sell Your Personal Data

5MC does not sell personal data to third parties in exchange for money or other valuable consideration, and does not disclose personal data to third parties for their own independent marketing or advertising purposes. We do not work with advertising networks, ad exchanges, or data brokers for these purposes.

The limited data we collect through the Website (for example, through enquiries you send us, or cookies and analytics) is used solely for the purposes explained in our Privacy Policy: responding to enquiries, managing our relationship with corporate clients and mentor applicants, and improving the Website. Where we share data with service providers, they act strictly as processors on our instructions and may not use your data for their own purposes.

2. Your Right to Object Under the GDPR (Article 21)

Where we process your personal data on the basis of our legitimate interest, for example, to send you information about 5MC's services or to analyse how the Website is used, you have the right to object to that processing at any time, on grounds relating to your particular situation. If you do, we will stop processing your data for that purpose unless we can demonstrate compelling legitimate grounds that override your interests, rights and freedoms, or the processing is necessary for the establishment, exercise or defence of legal claims.

Direct marketing: if we process your data for direct marketing purposes, including any related profiling, you have an unconditional right to object at any time. Once you object, we will stop using your data for direct marketing without further conditions. You can exercise this right by using the unsubscribe link in any marketing communication or by contacting us at hello@margaguitart.com.

Automated decision-making and profiling: you also have the right not to be subject to a decision based solely on automated processing, including profiling, that produces legal or similarly significant effects on you.

3. Withdrawing Your Consent (Article 7 GDPR)

Where any processing is based on your consent (for example, certain non-essential cookies or optional fields in our forms), you may withdraw that consent at any time, free of charge and as easily as you gave it. Withdrawing consent does not affect the lawfulness of processing carried out before the withdrawal. 4. Cookies and Interest-Based Advertising

Under the GDPR and the applicable ePrivacy rules, any non-essential cookie or similar technology (including any used for interest-based advertising) may only be placed on your device with your prior, informed and freely given consent, obtained through our cookie banner. This is an opt-in model: unlike jurisdictions that require you to opt out of tracking, 5MC does not set non-essential cookies unless you have actively agreed to them, and you can withdraw that consent at any time through your cookie preferences, as described in our Cookie Policy.

5. Other Rights Available to You

Beyond the right to object and to withdraw consent, the GDPR gives you a full set of additional rights over your personal data, including access, rectification, erasure, restriction of processing, and data portability. These are explained in full, together with how to exercise them and how to contact our Data Protection Officer or lodge a complaint with a supervisory authority, in our Privacy Policy.

6. California and Other US State Privacy Laws

If you are a resident of California or another US state with a comprehensive privacy law, you may have a right to opt out of the "sale" or "sharing" of personal information, as those terms are defined under the applicable state law (for example, the California Consumer Privacy Act, as amended by the California Privacy Rights Act). As explained in Section 1 above, 5MC does not sell or share personal information with third parties for cross-context behavioural or interest-based advertising, so there is currently no such activity to opt out of.

We also honour recognised opt-out preference signals, such as the Global Privacy Control (GPC), where technically supported by the Website.
